TERMS OF SALE AND DELIVERY
GENERAL TERMS

These terms of sale apply to all individuals (hereinafter “the customer”) who order goods from the www.hoily.eu e-shop (represented by HOILY OÜ, registry code 17219524), thereby concluding a purchase agreement. Purchases from the www.hoily.eu online store can be made by private individuals, business entities, and non-profit organizations.

By accepting these terms, the customer confirms that they have read, understood, and agreed to the terms of the purchase agreement and will comply with them.

By registering as a user on www.hoily.eu and/or purchasing products, these terms and the rights and obligations arising from the laws of the Republic of Estonia apply.

HOILY OÜ reserves the right to make changes to the terms of sale and prices. Any changes will be reflected on the www.hoily.eu website.

CONCLUSION OF THE PURCHASE AGREEMENT

HOILY OÜ sells and the customer purchases the offered products via the e-shop, by phone, by email, or in direct contact with an authorized representative of HOILY OÜ.

The purchase agreement comes into effect:

  • For private individuals, upon receipt of payment to HOILY OÜ’s account after confirmation of the e-shop order.

  • For business entities (payment by invoice), after the order is confirmed via the e-shop or by an authorized representative of HOILY OÜ (verbally or in writing).

PRICES

All prices on www.hoily.eu are in euros and do not include VAT, as HOILY OÜ is not a VAT payer.

HOILY OÜ reserves the right to adjust prices. If a customer has submitted an order before a price change takes effect, the price at the time of order submission applies. The customer has no right to claim compensation for any price difference.

ORDER PLACEMENT AND PAYMENT FOR GOODS

To order goods, the desired products must be added to the shopping cart. To complete the order, the required fields must be filled in, and a suitable delivery method must be selected. The total amount will then be displayed, which can be paid securely using the following payment methods:

Bank payments: Swedbank, SEB, LHV, Luminor, Coop, Citadele, Revolut, N26, Wise
PayPal

Note: When paying via bank link, be sure to click the “Return to merchant” button on the bank’s page.

Payments are processed by Maksekeskus AS. Payment occurs outside the e-shop in a secure environment – via bank link in the bank’s secure environment or via PayPal’s secure environment. HOILY OÜ does not have access to the customer’s bank or PayPal account information. The contract is concluded from the moment the payment is received in HOILY OÜ’s account.

HOILY OÜ is the data controller and forwards the personal data necessary for payment processing to the authorized processor Maksekeskus AS.

If the ordered goods cannot be delivered due to stock depletion or for any other reason, the buyer will be informed as soon as possible, and the paid money (including delivery costs) will be refunded immediately, but no later than 14 days after notification.

DELIVERY

Goods are shipped to the following countries: Estonia, Latvia, Lithuania.

The customer can choose the following delivery options: DPD parcel machine, Omniva parcel machine, Itella Smartpost parcel machine.

The customer bears the shipping costs, which are displayed next to the selected delivery method.

Domestic shipments in Estonia generally arrive at the destination specified by the customer within 2–3 business days from the conclusion of the purchase agreement.

Shipments to Latvia and Lithuania generally take 3–5 business days via standard postal services and parcel machines.

In exceptional cases, delivery may take up to 45 calendar days.

Shipments damaged during transport, where the products (but not the packaging) are damaged, will be replaced. If the customer receives a defective or incomplete product, HOILY OÜ must be notified immediately, and the product must not be used. If replacement is not possible, reimbursement of the product’s cost will be offered.

RIGHT OF RETURN

After receiving the order, the customer has the right to withdraw from the contract concluded in the e-shop within 14 days.

Returned goods must be unused, undamaged, and in the original packaging.

The customer bears the costs of returning goods, except when the return is due to non-conformity with the order or defective goods.

To return goods, a return request must be submitted in free form via email to info@hoily.eu within 14 days of receiving the goods. The request must include the customer’s name, product name, invoice or order number, and reason for return.

Refunds will be made as soon as possible, but no later than 14 days from receipt of the withdrawal request.

CLAIMS PROCEDURE

According to the Law of Obligations Act, the customer has the right to submit claims within 2 years of receiving the goods. If a defect appears within the first 6 months, it is presumed to have existed at the time of purchase.

If a product defect occurs, HOILY OÜ must be notified immediately via info@hoily.eu, providing: name, contact information, product defect, invoice/order number if possible, and a photo/video. Use of the defective product must be discontinued immediately. If the customer has modified the product, the seller has the right to refuse to accept the return.

HOILY OÜ is not responsible for:

  • Damage caused by the customer’s fault or negligence;

  • Defects resulting from improper use;

  • Normal wear and tear from ordinary use.

LIABILITY AND FORCE MAJEURE

HOILY OÜ is liable to the customer, and the customer is liable to HOILY OÜ for damages caused by a breach of these terms to the extent provided by the laws of the Republic of Estonia.

HOILY OÜ is not liable for damages or delivery delays caused by circumstances beyond its control or foresight.

PRIVACY

By using the www.hoily.eu website, the customer gives clear and informed consent to HOILY OÜ to process their personal data. HOILY OÜ uses the customer’s data solely for order fulfillment and does not disclose it to third parties, except as required by law or to authorized processors (e.g., transport, payments).

OTHER TERMS

Disagreements and disputes arising from the contract should primarily be resolved through negotiation. If no agreement is reached, the customer has the right to contact the Consumer Protection and Technical Regulatory Authority or the courts. HOILY OÜ also has the right to go to court to protect its rights.
